
$13k limit on a gift for aliens?
I am a citizen of Ukraine, living in Ukraine. I have an account with a US bank, and I want to transfer $15k to a US citizen. I know there is a $13k limit on gifts. All the gifts that exceed this amount are taxable (Correct me if I am wrong) and should be reported to IRS. As an alien without a legal status in the US (my work visa expired, and I returned home), am I a subject to this tax?
Some more details:

2) I do visit the States from time to time on business. Sometimes I work on contractual projects with the US businesses, and I use that bank account to get paid (which is another concern – should I pay taxes to uncle Bill from that income). So it’s important for me to be able to visit the States.
Not exactly correct. If someone subject to US tax laws gives over $13,000 in gifts to any one person in any one calendar year, they must file a gift tax return. They might or might not owe a gift tax on the gift.
A gift is never taxable to the person receiving it. And it doesn’t sound like you are subject to the requirement to file a gift tax return.
